STANDARD TERMS AND CONDITIONS OF SALE & PRIVACY POLICY

Welcome to PETSTORE. These Terms and Conditions govern your use of our website and the purchase of goods from PETSTORE LTD. By accessing this website, creating an account, or placing an order, you explicitly agree to be bound by the terms outlined below.

1. General Application & Commercial Terms

These terms apply to all sales of goods via our e-commerce platform. The customer explicitly waives their own standard terms and conditions. Any deviation from these terms must be expressly agreed to in advance and in writing by PETSTORE LTD. PETSTORE reserves the right to modify these Terms and Conditions at any time without prior notice.

2. Product Information and Pricing

  • All prices displayed on the website are in Mauritian Rupees (MUR) and are inclusive of Value Added Tax (VAT), unless otherwise stated.
  • We make every effort to ensure that product descriptions and images are accurate. However, PETSTORE LTD does not warrant that product descriptions are completely error-free.
  • Prices are subject to change without prior notice, but orders will be invoiced based on the prices in effect at the exact time the order is validated.

 3. Orders and Payment

  • An order is considered confirmed only when full payment is successfully processed through our secure online payment gateway.
  • PETSTORE LTD reserves the right to refuse or cancel any order in the event of stock unavailability, pricing errors, or suspected fraudulent activity. In such cases, a full refund will be issued.

 4. Delivery & Force Majeure

  • We aim to dispatch and deliver products within the stated timeframes at checkout. However, delivery times are estimates and do not constitute a strict obligation of results.
  • Risk of loss or damage to the goods passes to the customer upon physical delivery of the items to the provided address.
  • Force Majeure: PETSTORE LTD shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to cyclones, extreme weather events, strikes, internet outages, or global shipping disruptions.

 5. Return and Refund Policy

We want you to be completely satisfied with your purchase. If you need to return an item, the following strict conditions apply under our commercial policy:

  • Timeframe: You have a maximum of five (5) calendar days from the date of purchase (or date of delivery) to return an item.
  • Proof of Purchase: Returns will only be accepted upon presentation of the original till ticket, invoice, or digital receipt.
  • Condition of Goods: The item must be returned in good, sellable condition. This means the product must be unused, unwashed, free from pet hair or damage, and perfectly intact in its original packaging with all tags attached.
  • Exclusions: For hygiene and safety reasons, perishable goods, opened pet food, veterinary products, and grooming tools cannot be returned or exchanged unless they are confirmed to be defective upon delivery.

6. Data Protection and Privacy (DPA 2017 Compliance)

As a registered Data Controller with the Data Protection Office of Mauritius, PETSTORE LTD is committed to protecting your privacy.

  • Data Collection: We collect personal information (name, address, email, phone number, purchase history) strictly for the purposes of processing your orders, managing your VIP Club account, and communicating with you regarding your purchases.
  • Data Security: Your data is stored securely and will never be sold, rented, or distributed to third-party marketing agencies. We only share necessary data with trusted service providers (such as delivery couriers and payment gateways) strictly to fulfill your order.
  • Customer Rights: Under the Data Protection Act 2017, you have the right to request access to, correction of, or erasure of your personal data. Such requests must be submitted in writing to our management team and are subject to verification and statutory retention requirements.

7. Intellectual Property

All content published on this website, including but not limited to logos, branding, images, text, and marketing materials, remains the exclusive intellectual property of PETSTORE LTD. Any unauthorized reproduction, distribution, or use of this commercial material is strictly prohibited.

8. Limitation of Liability & Indemnity

  • PETSTORE LTD shall not be held liable for any indirect damages, loss of profit, or third-party claims arising from the use or inability to use the products sold on this website. Our total liability in respect of any order shall strictly not exceed the total purchase price of the specific goods ordered.
  • The customer agrees to indemnify and hold harmless PETSTORE LTD from any claims resulting from the misuse of products purchased from our platform (e.g., feeding incorrect food types, improper use of grooming tools).

9. Severability

If any provision of these Terms and Conditions is determined by a competent court to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

10. Governing Law and Dispute Resolution

  • All contractual relations between the customer and PETSTORE LTD are governed exclusively by the laws of the Republic of Mauritius. 
  • In the event of a dispute, both parties agree to seek an amicable resolution first. If an amicable agreement cannot be reached, the competent courts of Mauritius shall have exclusive jurisdiction.
